Q.

My partner's estate

My partner passed away and we had few or no documents protecting our relationship. Now his/her estate is in jeopardy. What do I do?

Response from Ms. Kendell

Unfortunately, your situation is all too common - many LGBT seniors have been living with a partner for decades, but have not taken measures to protect their relationship on paper for any number of reasons. When one partner dies, sometimes other family or even ex-spouses may enter the picture and even ignore you in what can be a messy battle for inheritance or property.

Depending on where you live, there may be ways for you to protect your joint estate. But you will probably need the help of an experienced attorney from your area, because the law really varies from state to state on this issue. You can contact NCLR today (info@nclrights.org) for help in finding a local attorney and for information that is specific to your state.
